Obligations.
Client agrees to comply with all reasonable requests of Firescape necessary
to the performance of its duties, including, without limitation, reasonable
access to the Property and use of utilities and water from and on the
Property related to the services.
Limited Warranty.
No warranty is expressed or implied regarding Firescape’s services,
recommendations and consultations, including, without limitation, any
inspection report, management planning consultation, fire-line construction
or any other services provided under this Agreement.
Limitation of Liability and Release.
Client acknowledges that fire and the damage it causes are not absolutely
preventable and that the local area surrounding the Property is vulnerable
to wildfire. Client agrees that, although risk of fire damage may be
reduced in connection with the services provided by Firescape and/or by
following its recommendations, no property or person can be made absolutely
safe. Client agrees that Firescape shall not be liable for any damage,
casualty or loss, whether actual or incidental, direct or indirect, arising
out of the services provided unless caused by Firescape’s gross negligence
or willful misconduct. Client agrees that, to the greatest extent permitted
by law, Firescape’s liability to Client and Client’s recovery of damages
under this Agreement will be limited to a one-time recovery of Firescape’s
fee paid hereunder. Client releases Firescape from any liability for and
will indemnify, defend and hold Firescape harmless from any and all
liabilities, claims or costs arising out of this Agreement except as
expressly stated herein.
